| dc.description.abstract | 차별시정제도가 도입·시행된 지 5년이 다 되어가고 있다. 비정규근로자에 대한 차별금지제도의 입법 취지는 비정규근로자에 대한 사용자의 자의적인 차별을 금지함으로써 직접적으로는 임금 및 근로조건 등의 개선을 도모하고, 간접적으로는 무분별한 비정규직의 남용을 억제하는 데에 있다. 그러나 이와 같이 좋은 입법 목적을 가지고 있다고 하더라도 차별시정제도가 활용되지 않거나 적용될 수 없다면 단지 장식품에 지나지 않을 것이다. 이 글은 차별시정제도가 시행된 2007년 7월부터 2012년 2월 말 현재까지 지노위·중노위에서 판정한 사건 및 법원에서 판결한 사건의 전수조사한 내용을 토대로 비정규근로자에 대한 차별시정제도의 현황과 특징을 살펴보았으며, 법해석 및 차별판단 기준에서 나타난 몇 가지 쟁점을 검토하였다. 이러한 검토를 토대로 향후 차별시정제도의 운용상 및 입법적 개선방안을 모색하였다. 이러한 개선방안이 차별시정제도의 활용도를 제고하는 데에 얼마간의 도움이 되길 바란다. | - |
