- Abstract
- 이 글은 민사소송인지제도의 합리적 개선을 위한 시론적 연구이다. 노동사건을 비롯한 각종 집단소송에서 현행 소가 일변도의 인지대 산정제도는 국민의 재판청구권을 실질적으로 보장해 주지 못하는 측면이 있다. 이에 대한 시론적 대안으로 필자는 인지대의 상한과 하한을 정하고, 기본인지대와 추가인지대로 나누며, 사안의 특성을 고려하여 법원이 추가인지대의 증액 또는 감액을 할 수 있도록 하고, 나아가 사안에 따라서는 원고 뿐 아니라 피고에게도 추가인지대의 전부 또는 일부를 납부하도록 하는 방향의 제도개선을 제안하고 있다.
