| dc.description.abstract | 2017년 3월에 대한민국 영해에서 수 천 킬로미터 떨어진 대서양 공해 상에서 발생한 스텔라데이호 침몰 사고는 재난과 관련되어 국가가 부담해야 하는 책임의 범위에 관한 논란을 불러일으켰다. 더 나아가 재난과 관련되어 국민이 국가에 대하여 주장할 수 있는 기본권에 관한 논란도 발생시켰다. 국가의 기본권보호의무에 상응하는 기본권이 인정될 수 있다고 하더라도 이러한 기본권은 재난과 관련된 형사입법을 요구할 수 있는 권리에 국한된다. 따라서 재난과 관련된 국민의 기본권은 망자를 애도할 권리 및 억울한 죽음을 당하하지 않을 권리와 같은 적극적 권리로 확장되어야 한다. 망자를 애도할 권리는 시신이나 유해의 수습을 통해 적절한 장례를 치를 수 있는 권리를 의미한다. 억울한 죽음을 당하지 않을 권리는 사고원인 및 사망원인을 규명하여 망자가 억울하게 죽지 않을 권리를 뜻한다. 재난과 관련된 형사입법을 요구할 수 있는 권리, 망자를 애도할 권리 및 억울한 죽음을 당하지 않을 권리와 같은 적극적 권리의 경우에는 기본권제한에서 요구되는 헌법적 원칙인 비례성원칙이 과소금지원칙으로 구체화되어야 한다. 이러한 과소금지원칙에 따라 적극적 권리의 침해 여부를 판단할 때는 해당 적극적 권리를 구체적으로 형성하는 제도 전체를 전반적으로 검토하여야 한다. 따라서 이와 같은 적극적 권리는 특정한 사건의 당사자가 특정한 상황에서 개별적으로 필요한 구체적 급부를 요구할 수 있는 권리로 이해될 수는 없다. | - |
