| dc.description.abstract | 헌법재판소는 수형자 등과 구속된 피고인 등의 디엔에이정보를 수집하고 이용하는 것을 허용하는 ‘디엔에이신원확인정보의 이용 및 보호에 관한 법률’에 대한 헌법소원심판청구 사건에서 합헌결정을 하였다. 이 법률이 신체불훼손권과 개인정보자기결정권을 침해하지 않고, 소급입법에도 해당하지 않는다고 한다. 비례성원칙(과잉금지원칙)을 위반할 만큼 과도한 제한은 아니라는 것이다. 하지만 신체불훼손권을 근거를 신체의 자유에서 찾고 있는 점, 개인정보자기결정권의 헌법적 근거가 판례에 따라 열거되지 않은 개별적 기본권(헌법 제37조 제1항) 또는 사생활의 비밀과 자유(헌법 제17조)로 다르다는 점, 소급입법금지원칙의 적용하면서 진정소급입법과 부진정소급입법의 이분법을 견지함으로써 소급입법의 허용성이 본질적으로 법적 안정성과 정의의 형량이라는 점을 간과하고 있다는 점은 문제점으로 지적될 수 있다. 근본적으로 헌법재판소는 의도적이지는 않겠지만 사형제도, 신상공개제도, 전자발찌제도 등과 같은 형벌 및 보안처분 관련 사례에서 형벌과 보안처분의 강화를 통해 범죄에 대한 국가책임을 벗어나려는 노력을 정당화하고 있다는 비판을 면하기 어렵다. | - |
