2018년 제70차 회기 유엔 국제법위원회 작업현황과 제73차 유엔총회 제6위원회 논의결과

초록

The series of the article has been published since 10 years ago in this Review. The main purpose of this article is to provide information objectively as possible the works done by the UN ILC to domestic scholars, so that the author tried not to add the subjective opinion or evaluation. In this article, the author explains the works done by the UN International Law Commission during its 70th session (2018), last year: more concretely, the 2nd reading draft on “Subsequent agreements and subsequent practice in relation to the interpretation of treaties”, the 2nd reading draft on “Identification of customary international law”, the 1st reading draft on “Protection of the atmosphere”, the 1st reading draft on “Provisional application of treaties”, on-going works’ results on “jus cogens”, “Protection of the environment in relation to armed conflicts”, “State succession in relation to State responsibility”, “Immunity of State officials from foreign criminal jurisdiction”. The author summarizes the statements made by the member States participated in the 6th Committee of the UN General Assembly. This article also explains the long-term program of works proposed by the ILC and reactions given by the Member States. The author proposes to the Korean Government and domestic scholars to draw his/her attention especially to the 2nd reading draft articles on “Crimes against Humanity” that might be adopted by the ILC during its 71st session(2019).
