미혼모 관련 법제도의 분석과 평가

초록

A variety of legal institutions are introduced in order to guarantee the rights of unwed mothers. These legal institutions are separated into laws relating to acknowledgement/parenting, laws relating to discrimination, laws relating to adoption and laws relating to welfare. First of all regarding acknowledgement and parenting, litigation support policies should be provided by government. Secondly regard to adoption, government should support birth mothers in order to nurture their children and configure adoption process considering the welfare of the child by respect to unwed mothers who need to select adoption inevitably. Thirdly regarding the discrimination, measures necessary for the correction of discrimination must be taken, if discrimination on the basis of marital status or pregnancy/birth is truly not in accordance with the laws such as National Human Rights Commission Act or the Equal Employment Act. Lastly regarding the welfare, it is necessary that benefits based on the Single-Parent Family Support Act need to be upgraded so as to be able to meet the practical needs of unwed mothers.
