- Abstract
- 본 논문은 경쟁법의 목표에 대한 기존 문헌들을 검토한다. 특히 부분 균형적 분석에 입각한 정태적 효율성 극대화에 관한 기존 가설의 한계를 제시하며, 이에 대한 대안으로서 소비자 후생과 함께 동태적 효율성의 개념을 반영하는 심결기준이 필요함을 지적한다. 이러한 심결기준이 실제로 공정거래위원회에 채택되고 있는지에 대한 실증분석을 위해 지난 10년 동안의 수평결합을 중심으로 구제조치의 결정요인들에 대한 반비모수추정을 시도한다. 이를 토대로 공정거래위원회에서 소비자잉여 뿐 아니라 기업결합 특유의 효율성을 고려하는지에 대한 가설을 검토해 본다.
