- Abstract
- 본 논문의 목적은 미국 교육법 연구의 최근 동향과 쟁점들을 분석하는 것이다. 최근의 연구동향 및 주요 쟁점은 미국 교육법연구의 대표적 학회인 ELA의 2006년도 학술대회 발표주제들, 그리고 미국 교육법의 대표적인 논문집인 「West's Education Law Reporter」와「Journal of Law & Education」에 게재된 2005-2006년도의 논문주제들을 종합 분석하여 선정하였다. 이러한 분석 결과 최근의 핵심적인 미국 교육법 쟁점으로 첫째, 장애아동의 교육(IDEIA)에 관한 관계 법령의 주요내용과 쟁점이 되고 있는 판례를 살펴보았다. 둘째, NCLB(No Child Left Behind Act of 2001)의 주요내용과 원칙을 살펴보고, NCLB의 위헌성 문제를 분석하였다.셋째, 학교환경의 안전성과 학생지도 문제로 학교에서의 폭언과 폭력, 괴롭힘, 수색과 체포의 법적 문제들을 살펴보았다. 마지막으로 이러한 쟁점들이 한국의 교육법 연구에 주는 시사점을 몇 가지 지적하였다.
