- Abstract
- 2018년 헌법 중요 판례로 주요 헌법재판소 결정들을 살펴본다. 선정된 결정들에서 다루어진 주요 쟁점들은, (1) 헌법 제12조 제4항 본문의 변호인의 조력을 받을 권리가 행정상 구금된 자에게도 보장되는지 여부, (2) 출입국관리법의 보호대상으로 구금되어 있는 외국인의 기본권, (3) 체포영장 집행을 위한 영장 없는 주거 수색의 위헌성, (4) 양심적 병역거부자를 위한 대체복무를 규정하지 않은 병역법의 위헌성, (5) ‘과거사 사건’에 관한 국가배상청구사건들에 적용되는 소멸시효에 관한 민법조항들의 예외적 위헌성 등이다.
