- Abstract
- 디지털 증거와 종래의 유체물 증거는 본질적으로 많은 차이가 있다. 따라서 각각에 대한압수수색 절차는 달라질 수밖에 없고, 압수수색 절차가 달라짐에 따라 그 과정에서 피압수자측에게 인정된 참여권을 보장해 주는 방법 또한 달라져야 한다. 그럼에도 형사소송법과 수사기관의 압수수색 관련 규칙은 유체물 증거에서와는 다른 디지털 증거 압수수색 과정에서의참여권 보장 방법에 대해 별도의 상세한 규정을 두고 있지 않다. 이에 본 논문에서는 디지털증거 압수수색 과정 중, 특히 디지털 증거탐색 과정에서의 참여권 보장 방법과 관련하여유체물 압수수색 과정에서는 찾아 볼 수 없었던 여러 가지 문제점들에 대해 검토한 후, 피압수자 측의 참여권을 보장하기 위한 실질적 대안으로서 디지털 증거탐색 컴퓨터영상 녹화제도를 제안하였다.
