선박우선특권상 채무자와 선적국의 의미 - 2014년 대법원 판례를 중심으로-

| dc.description.abstract | 선박우선특권은 채권자를 보호하는 훌륭한 제도이다. 선박자체가 피고라는 관념이 도입되었기 때문에 채무자와 무관하게 선박은 압류되어 임의경매된다. 이와 관련하여 피담보채권을 발생시킨 채무자의 지위와 선박우선특권이 어떠한 관련이 있는지를 보여주는 대법원판결이 2014년에 나왔다. 정기용선자가 발생시킨 채무는 선박우선특권의 대상이 아니라는 것이 국제조약의 입장이다. 우리나라는 학설에 따르기 때문에 법적 안정성이 떨어진다. 외국적 요소가 개입된 경우에 선박우선특권은 국제사법 제60조에 의하여 선적국법에 따른다. 우리 대법원은 편의치적선의 선박우선특권의 법률관계를 정하는 법률은 가장 실질적인 관련성을 갖는 국가의 법이 되어야 하고, 나용선등록 선박의 경우 선적국은 원등록국이 되어야 한다고 판시하였다. 선박우선특권 관련자들에게 법적 안정성과 예측가능성을 부여하기 위하여, 정기용선자의 경우에도 선박우선특권이 발생하는 채무자가 될 수 있도록 상법에 규정화하여야 한다. 국제사법 제60조의 선적국의 개념에 통일성을 기하기 우하여 법정지법을 적용하는 안을 제안하였다. | - |
