- Abstract
- 이 글은 대법원 2013. 12. 18. 선고 2012다89399 퇴직금 판결에 대한 평석이다. 대법원은 특정수당 등에 대해 통상임금으로서의 성격을 배제하기로 하는 당사자간의 약정이 강행규정위반으로 무효임을 선언하면서도, 그 지급을 구하는 근로자측의 청구가 신의칙에 반할 수 있다는 취지로 원심을 파기환송하였다. 필자는 파기환송 후 심리에서 관심사항이 될 수 있는 신의칙 적용의 요건과 효과를 염두에 두고 영미법상 금반언(estoppel)의 법리를 참고하면서 대상사안에 신의칙을 적용하기 위한 요건상의 구체적인 세부쟁점과 효과를 중심으로 평석하고 있다.
